What happens next

  1. Collector must STOP all collection activity until they validate. Calls, letters, credit reporting of the debt as "disputed" if they continue to report.
  2. They must provide: proof of the debt, proof of the amount, proof of their legal right to collect it (chain of assignment from original creditor).
  3. Common failure mode: debt buyers often can't produce this chain, especially for old "zombie" debts bought for pennies on the dollar. If they can't validate, the debt is effectively dead.
  4. If they ignore you and keep collecting: that's a $1,000 statutory violation per FDCPA §813. Document everything.
  5. Timing matters: You must send within 30 days of their first written notice for the automatic stay protection.
Statute of limitations warning: "Reviving" old debts by acknowledging or paying on them can restart your state's statute of limitations. If the debt is close to or past SOL, talk to a consumer attorney before doing anything that could be construed as acknowledgment.
